Pedestrian Accident Claims

The consequences of being involved in a road traffic accident as a pedestrian can be very serious, and accidents can often result in long-term, perhaps life-changing injuries for the victim.

As experts in handling compensation cases relating to all kinds of road traffic accidents in the UK, our specialists at Hudgell Solicitors have seen a significant increase in the dangers posed to pedestrians in recent years.

Not only are increasing numbers of vehicles and pedal cyclists using the roads, but they are doing so with ever-more distractions impacting on safety, such as the increasing use of mobile phones behind the wheel leading to the potential for more pedestrian accidents.

This places an extra emphasis on the need for pedestrians to ensure they are alert and aware of danger at all times. However, despite taking all possible precautions, pedestrians are still vulnerable on the roads and very often are the victim of either careless, poor or outright dangerous driving.

Over the 12 months from December 2014, Hudgell Solicitors’ specialist road accident compensation claims team helped 129 pedestrians through no win no fee legal representation, after being injured on roads through no fault of their own.

We helped them secure compensation for their pain and suffering, assisted them by securing access to crucial rehabilitation support and medical treatment and assessments, and recovered financial losses which they had suffered as a result of their accidents.

We have represented clients who have been injured due to;

  • Motorists going too fast
  • Drink-diving
  • Vehicles mounting the pavement
  • Drivers failing to stop at pedestrian crossings
  • Drivers failing to pay full attention to the road
  • Drivers under the influence of drugs
  • Traffic lights being ignored or not seen

The law predominantly places responsibility on drivers to prevent accidents from occurring, so should you be involved in an accident that wasn’t your fault, and suffer injury as a result, you could be entitled to compensation.

Regardless of the severity of your accident, our expert solicitors can provide you with the legal advice, knowledge and commitment needed to not only secure compensation, but also provide support and guidance to help you start rebuilding your life.

Expertise and accreditation’s mean you can trust the Hudgell Solicitors team

Our dedicated team of accident and injury solicitors are highly experienced in handling pedestrian injury claims across the UK.

We are members of the Association of Personal Injury Lawyers (APIL), an organisation dedicated to improving services for victims of personal injury, so you can feel comfortable and confident with our advice and service.

We have also been awarded a Lexcel Accreditation from The Law Society and are recommended as a leading firm in The Legal 500’s 2015 edition.

As personal injury specialists, we also work hard to campaign for improved safety on the roads.

It has seen us support national road safety charity Brake in calling for a national ban on hands-free calls in cars, as research has suggested that talking makes drivers four more times likely to cause an injury.

Meet our expert, Jane Woodcock, Head of Personal Injury

“Often, pedestrian victims in road traffic accidents suffer very serious injuries.

“Accidents happen for many reasons, and there is of course a big responsibility on pedestrians themselves to make sure they are using roads safely and accordingly. However, it is clear that the UK’s roads are becoming more of a threat, with more vehicles and an ever-increasing number of distractions.

“We see many injuries to pedestrians which have huge impact on the quality of life they are able to enjoy. Not only do victims often suffer serious levels of pain and suffering, they can also be left unable to walk for many months, and unable to earn to support their loved ones.

“Our aim at all times is to ensure our clients are not only compensated for their pain and suffering, but also to ensure they benefit from the necessary treatment and rehabilitation needed to get them back to health.

“Importantly, we also have a track record of ensuring we also recover any financial losses, which can include costs incurred when travelling for treatment, but also loss of earnings, which in some cases can be only a few weeks, but in more serious cases can be for a long-time into the future.”

Case study: Five-figure settlement for grandmother hit by car on zebra crossing

A grandmother who was knocked down on a zebra crossing and seriously injured – breaking both her right arm and leg – was awarded a substantial five-figure sum in compensation for her injuries and suffering.

Hudgell Solicitors represented Janet Churchley, of Boothferry Road, Hull, following an accident which left her confined to a wheelchair for three months, unable to work for close to a year, and with extensive scarring from surgery on her leg.

She was only able to return to work on a part-time basis, and left feeling anxious when crossing roads given the horrific experience she went through.

Mrs Churchley had checked both ways and stepped out onto the crossing in a busy city centre, only to suddenly be hit by a car which failed to stop.

She was treated at the scene by paramedics and given air and oxygen before being rushed to hospital in an ambulance. She spent three months in a wheelchair, with her leg straightened in front of her, and was forced to sleep on the sofa downstairs for three-and-a-half months.

Insurers of the driver admitted liability for the accident, and Jane Woodcock, head of personal injury at Hudgell Solicitors, ensured Mrs Churchley had the very best medical care, and legal representation throughout her case.

“I was delighted with the support I had from Hudgell Solicitors. They were recommended to me and I can’t speak highly enough of the service they gave me,” said Mrs Churchley.

“Jane Woodcock in particular was excellent. She came to see me at home firstly and told me there and then that I could contact her at any time. She was good to her word. I was always kept updated with my case, and whenever I called, Jane would get back in touch with me.

“I was sent for MRI scans and X-rays, which were arranged for me. Also, with the case taking a long time to reach an agreement, they even advanced me some funds against the final pay-out to ensure I was not left out of pocket.

“Jane also fought for me to receive extra compensation for not being able to remain in work full-time. She didn’t accept the first offer made to us, and that resulted in me receiving a better final compensation pay-out.”
