What is a whiplash injury?
A whiplash injury is a common result of a road traffic accident (RTA), usually occurring when the vehicle you are travelling in is hit by another from behind, also known as a rear-end collision.
The body is thrown forward but the head lags, causing hyperextension of the neck, resulting in damage to muscles in the neck, back and shoulders.
The most common symptoms of whiplash include:
- Neck pain – difficulty moving up, down or side to side.
- Upper and lower back pain.
- Pain or discomfort in shoulders or arms.
- Pain when walking.
- Headaches.
- Blurred vision.
- Swelling and inflammation.
- Dizziness, fatigue and nausea.
- Difficulty sleeping.
- Psychological symptoms – flashbacks, travel anxiety, avoidance of travel, Post-Traumatic Stress Disorder (PTSD) symptoms etc.
Can I claim compensation for a whiplash injury?
Following changes in the law in 2022, claims for compensation relating to soft tissue (muscular) injuries are now dealt with under the Official Injuries Scheme (OIC), which is designed to be pursued in person online, without the involvement of lawyers.
Compensation levels are dictated by a set, fixed Tariff rating.
The Scheme also applies to accidents in which both whiplash and additional injuries are sustained – the criteria being that if the likely total value of the injury claim is £5,000 or less (this figure does not include financial losses), then the OIC Scheme will still apply.
In accidents involving combined injuries, the Tariff rating continues to apply to the whiplash/soft tissue element of the claim.

If we feel you need to use the Government’s Official Injury Claim Scheme (OIC), our team will point you in the direction of some helpful advice and support. If we feel you will benefit from our representation, your solicitor will assess your case and investigate every aspect of the incident to determine who was responsible for the accident.
We’ll help you through every step, including contacting anyone who may have witnessed the accident. We’ll also liaise with the other party’s insurance company to look to establish negligence and try to negotiate a settlement.
If a third party driver is deemed to be either uninsured or untraceable, a claim can be pursued against the Motor Insurance Bureau – a Government body set up to compensate victims of road traffic accidents where the responsible driver is either uninsured or untraced.
The MIB operates two distinct Schemes. These are not ‘no fault’ Schemes – it is still necessary for the applicant to establish that the accident/injuries resulted from negligence on the part of the uninsured/untraced driver. We always seek to settle cases through negotiation, thereby avoiding court hearings where possible.
However, we will consider commencing court proceedings should defendants continue to deny liability where there is sufficient evidence to justify issuing proceedings or if we feel this action is needed to maximise the compensation you are awarded.
As part of our service we will arrange for you to be medically examined by an expert to provide an independent report to support your claim for personal injury. This report will also be used to value your claim.
If rehabilitation or further investigations are recommended by the expert, we will consider your needs and arrange these on a private basis where we can. Once your medical evidence and losses have been finalised, your solicitor will discuss your settlement options.
