Brain injury specialist calls for rehab driven approach

A Solicitor who specialises in handling compensation cases involving traumatic brain and spinal injuries says claims must have a ‘rehabilitation-driven approach’ to ensure clients are given the best opportunity to rebuild their lives.

A Solicitor who specialises in handling compensation cases involving traumatic brain and spinal injuries says claims must have a ‘rehabilitation-driven approach’ to ensure clients are given the best opportunity to rebuild their lives.

Chris Moore, of personal injury and medical negligence specialists Neil Hudgell Solicitors, deals with many cases involving life-changing brain and spinal injuries in his work, and says the focus for legal professionals from the outset of all cases must be on securing the right rehabilitation support – both in the short and long term – for all clients.

It comes as the national brain injury association, Headway, has issued a stark warning to the Government that it faces a ticking time bomb by reducing brain injury survivors’ access to support and rehabilitation services.

“We often emphasise the importance of taking a rehabilitation driven approach to all brain and spinal injury cases. Understanding the diagnosis, prognosis and the implications of the client’s injury is a crucial part of the lawyer’s role,” said Mr Moore.

Mr Moore, a member of the Law Society’s specialist clinical negligence and personal injury accredited panels, says the earlier in a case that rehabilitation can start, the better the outcome usually is for the client.

However, he stresses a long term view of the patient’s condition is also crucial to ensure they have the best possible support throughout their claim.

“It ensures clients get the treatment and interim payments they need, for example to adapt a home or buy a new one, before any final compensation settlement is agreed,” he said.

“Unlike other injuries, the full impact and extent of brain and spinal injury can often take years to become fully apparent. That’s why, from a legal point of view, clients with brain and spinal injuries need an agile response to cope with initial needs coupled with a clear, long-term assessment and approach.

“Top class medical support is often based on a solid and realistic compensation settlement.  We recognise that the life-long challenges facing all those touched by the injury are ones that money can seldom cure. A successful brain injury claims settlement that covers the cost of a quality care package goes a long way towards helping a client and family re-build their lives.”
