Hull teens secure six-figure damages after suffering serious motorcycle accident injuries

And this expertise has again been demonstrated after two Hull teens instructed Hudgell Solicitors to make motorcycle accident claims after being injured through no fault of their own – one of the incidents happening on the roads and the other during an offroad cross-country activity.

The first motorbike accident involved an 18-year-old man who was knocked off his motorbike just 200 metres from his front door by a driver in a hire car.

The driver was travelling in the opposite direction to the rider when suddenly, without warning, they turned across the path of our client. The young man, who had been riding bikes since shortly after his 16th birthday, was unable to stop in time and was thrown from his motorcycle after the collision, suffering extensive leg and arm injuries in the process, as well as scarring.

He fractured his left leg in four places and underwent extensive surgery with the application of an external fixator frame which remained in place for over a year; fractured his right leg which also suffered a significant wound; fractured his left arm which was surgically plated; his second toe on his right foot was partially severed and had to be surgically repaired; and he also suffered skin loss.

He underwent a prolonged recovery period during which he also experienced psychological issues including intrusive thoughts, nightmares, low mood, disturbed sleep and suffered travel anxiety about ever riding a motorbike again.

Client ‘at a permanent disadvantage’ claims for motorbike accident compensation

Jane Woodcock, Head of Personal Injury at Hudgell Solicitors, represented the teenager in the motorcycle accident compensation claim and implemented rehabilitation sessions to aid his recovery.

She said: “We alleged negligence on the part of the car driver as the cause of the accident and of our client’s very significant injuries.

“Our client was a fit young man with hobbies including jet skiing, but our medical expert in the case reported that he is unlikely to be able to return to his pre-accident sports activities and that he will remain at a permanent disadvantage on the open labour market, in particular for heavy lifting, or stair and ladder climbing.

“Our client limps when he walks and remains unable to run. He has significant residual scarring from his injuries. He no longer rides motorcycles due both to physical and psychological issues, but happily is back in employment and looking positively to the future.”

Liability was fully admitted by the insurers of the offending motor car and Mrs Woodcock successfully secured £130,000 in damages for her client, which took into account his future handicap on the labour market.

Specialist motorcycle accident lawyer helps 13-year-old after ‘complex ankle injury’

One of our expert motorcycle accident lawyers also represented a 13-year-old who was involved in a motorbike crash at a holiday camp in Norfolk.

The boy was participating in an organised cross-country motorcycle activity, riding a 125cc bike around a grass circuit. As he was on his fourth lap around the circuit, the boy noticed that he was heading towards a log and pressed the brake, but the motorcycle did not slow down.

He then pulled the emergency stop lead, but this did not work and he subsequently crashed into the log. He was thrown into the air before landing heavily on his left ankle on the motorbike itself.

The boy suffered extensive injuries to his left leg, including fracturing his tibia and badly damaging cartilage in his ankle, which required surgery and plating. He wore a cast for around six weeks and was on crutches for up to three months.

Sarah Kidd, Associate in the Personal Injury team at Hudgell Solicitors, represented the boy and his family in the motorcycle accident claim.

She said: “As in all personal injury cases, we obtained the advice of a medical expert who assessed our client and confirmed he had suffered a complex ankle injury.

“His evidence was that, in the longer term, the client had a greater than 80 per cent chance of developing degenerative (arthritic) change in his ankle joint, which would lead to increasing stiffness and pain.

“My client still walks with a limp and the medical expert confirmed that his ankle symptoms will continue to restrict him in day-to-day activities, particularly if he is involved in activities that involve standing for long periods or heavy lifting.

“His injuries mean he will be at a permanent disadvantage on the open labour market, in particular in work that would require him to squat, kneel, walk or stand on uneven surfaces or carrying out heavy lifting.”

Breach of duty was admitted by the operator of the holiday camp and Mrs Kidd successfully secured £105,000 in motorcycle accident compensation for her client.
