Father of two dies after GP fails to act on abnormal growth on bowel

Father-of-two Wayne Evans was not informed of test results by his GP surgery which had showed an abnormal growth on his bowel. Three years later, when taken ill again, he was found to have inoperable cancer. He had initially been referred for tests by his GP after experiencing tenderness in his stomach and diarrhoea, and it was alleged that had the growth been removed when first identified, he would still be alive and cancer free.

Three years later, when taken ill again, he was found to have inoperable cancer. He had initially been referred for tests by his GP after experiencing tenderness in his stomach and diarrhoea, and it was alleged that had the growth been removed when first identified, he would still be alive and cancer free.

The Legal Process

A medical negligence claim was submitted against the GP Surgery involved alleging that results from the tests in 2008, showing the abnormal growth, had been wrongly filed away, leading to Mr Evans not being informed of the need for surgery. Although no formal admissions were made by the surgery, a six-figure damages settlement was offered following legal representation through Shauna Page on behalf of Mr Evans’ widow, Clare.

Settlement

The settlement for Clare and her family took into Hooters20account the avoidable pain and suffering Wayne endured, the impact it had on their lives, and the loss Clare and her daughters Natasha and Chloe suffered as a result.

Testimonial

It was Wayne who contacted Hudgell Solicitors in January 2012 because he wanted someone to be accountable. Sam has been lovely and so helpful. He was always around to speak to me and always listened. I’m glad we were able to hold people to account, and hopefully by sharing what happened to Wayne others will take action if something similar happens to them.” – Clare Evans

Hudgell Solicitors Comment

This was a tragic case, and although no amount of money can ever reflect the loss of life, it was very important to ensure Clare was financially in the position she would have been had Wayne still been alive and providing for his family – Shauna Page.
