On 10 March 2011 Dorothy had been quite upset and agitated and she was removed from the communal area by her carers and taken to her room. She was left alone in her wheelchair and within twenty minutes she was found on the floor, having fallen from her wheelchair.  Initially she suffered bruising to her nose and face and a cut to her temple.

The daughter of an elderly woman, who died after a fall in a BUPA care home, has received compensation after approaching Hudgell Solicitors.

92 year old Dorothy Mason who lived in Manchester, died on 24 March 2011, following a fall from her wheelchair at her BUPA care home.

Three days after the fall Dorothy was unable to walk and became progressively unwell.  Just over a week later she was diagnosed with aspiration pneumonia and referred to the hospital where she sadly died.

Linda McTaggart, Mrs Mason’s daughter, approached Hudgell Solicitors in April last year as she felt BUPA had been negligent and would not accept responsibility for what had happened.

Medical Negligence solicitor, Tasmin White said:  “We funded obtaining expert evidence as we considered that her family did have grounds to be concerned about the way that Mrs Mason had been treated and particularly that the fall contributed to her pneumonia. Despite the Defendant’s denial of liability we were ultimately able to recover compensation for Dorothy’s family.”

Linda McTaggart commented: “I am very happy with the service I have received from Tasmin at Hudgell Solicitors. There was a time when taking the case any further looked difficult but Tasmin felt we had a case for negligence. I can only thank you all at Hudgell Solicitors.”
