Compensation for 26-year-old after dentist failed to remove baby teeth

Dental patient Guy Jackson still had his baby teeth into his 20s, preventing the development of his adult replacements and leaving him with gaps. This has led to him facing prolonged treatment to bring his adult teeth through, which could have been avoided.

The legal process

An independent dental expert was asked to provide a report into the dental care Mr Jackson had received. He advised that the dentist should have referred Mr Jackson for an orthodontic referral by the time he was 10-11 years old. A second expert said that as a result of the negligence Mr Jackson had been put at risk of suffering root absorption and that as an adult, the process of the treatment would longer than had he had the treatment at a younger age.

Settlement

An offer of £8,000 damages was initually made on behalf of the defendant. Mr Jackson said he would look at settling for £9,000 and as s result of a without prejudice discussion between the two parties, the defendants agreed to increase their offer to £9,000, which was then accepted without the need for a court hearing.
