A Hospital Trust admitted being at fault for the death of 85-year-old patient after failing to give her vital blood-thinning medication for more than two days. Sheila Brock died after developing a massive blood clot and suffering a heart attack due to the error.
The legal process
A Serious Incident Review, which was carried out by the Hospital Trust and highlighted errors around the system used to allocate and administer medication to patients, was supportive to the legal claim and assisted our medical negligence team in progressing the claim of negligence.
The Trust wrote to the family of Mrs Brock and offered an unreserved apology and made an offer of damages which was accepted.
Hudgell Solicitors comment
“In this case the circumstances had already been subject to a Serious Incident Review at the Trust. In light of the findings in that report we were able to seek early admissions and settlement from the defendant on behalf of her family, which were thankfully forthcoming. It was a shocking case as Mrs Brock lost her life due to procedural errors and oversights.” – Solicitor Shauna Page.
“We felt we had to seek legal advice and take action as there was no care shown to my sister. She was just another number on the ward, she wasn’t treated as a person and that’s why nobody realised she hadn’t had her medication.’ – Sandra, Mrs Brock’s sister.
