Compensation for suspended subpostmasters
Hudgell Solicitors is supporting former subpostmasters to claim compensation for periods in which they were suspended from their position and had their salaries withheld from them.
Before March 2019, subpostmasters were not remunerated during the period of any contract suspension.
As a result of the Group litigation Order in 2019, a scheme was set up to compensate anyone who suffered loss through suspension during that period.
Expert legal advice on applying for compensation
Former subpostmasters who were suspended and denied pay prior to March 2019 can apply for compensation by requesting a Suspension Remuneration Review into their case.
Legal advice is required to assess whether offers are fair and reasonable.
It might be that the calculation is wrong and that you have other consequential losses directly flowing from the suspension. Those losses could be significant. We have seen cases where compensation offers have been many thousands of pounds lower than the amount the claimant was entitled to.
Once we have your review documentation, and before we start work, we will agree with the Post Office payment of our fees so that there is absolutely no cost to you.
What will the Suspension Remuneration Review consider?
The review is in place to consider the full impact a period of unpaid suspension has had on a former subpostmaster and ensure they are fully and fairly compensated.
This may include not only the loss of pay during the period of suspension but also other costs caused, such as if a subpostmaster then needed to take out a loan or cover the cost of legal and accountancy advice following their suspension.
Loss of property, such as causing the need to sell a property at a reduced value, or the loss of opportunities such as opening a retail business alongside a Post Office, can also be considered.

Is the Post Office contacting people affected directly?
Yes, the Post Office says it is actively contacting former subpostmasters about the Review to provide information and guidance on how the process works. However, we have seen from all previous schemes, that not all people affected are contacted, so if you are a former subpostmaster and you who was suspended before March 2019, and had your pay stopped, but have not yet been contacted, contact the Post Office directly to start the process.
How do I apply for a Suspension Remuneration Review?
You can request a review of your past suspension remuneration by completing a Suspension Remuneration Review request form at https://corporate.postoffice.co.uk/remediation.

How will my case be assessed?
The Post Office will pay subpostmasters the remuneration which was not paid to them during any period of suspension, plus interest.
If a subpostmaster feels their remuneration should exceed that offered, they can provide evidence to support a claim for greater compensation. They can also claim for consequential issues directly caused by their suspension.
We strongly advise seeking a legal opinion as to whether the offer of compensation is fair. It might be that significant consequential losses have not been accounted for.

How do I provide evidence of consequential losses?
Evidence includes Postmasters’ own explanation of the facts, with greater weight given to contemporaneous evidence (such as documentation issued at the time of the loss, such as invoices for fees paid), and factual evidence that is undisputed, verifiable, or consistent with other evidence.

Is there a time limit for applying for a Suspension Remuneration Review?
The Post Office has said it will review all cases submitted until March 14, 2025, under the law of limitation.
