Compensation of £1.4m for car passenger who suffered brain injuries

Hudgell Solicitors has secured damages of £1.4m – and ensured a full programme of rehabilitation support has been provided – for a man who suffered catastrophic brain injuries when a sports car he was a passenger in crashed at speed.

The man had been the main breadwinner and a hands-on family man before he was involved in the accident. However, as a result of his injuries in the road traffic accident, his personality changed completely as he now has significant cognitive and behavioural problems.

The claimant, of West Wales, had been the front seat passenger in a sports car when the driver lost control. The car left the road at speed and rolled over in an adjacent field, with the claimant having to be cut free from the wreckage by a fire crew.

As well as his brain injury, he suffered numerous other serious injuries, including facial fractures, fracture of the right shoulder and lower back, and a perforated ear drum.

Sarah Patten, senior solicitor at Hudgell Solicitors who specialises in serious injuries, said his injuries were life-changing, not only for himself, but also for his wife and children.

He now has a poor memory and has difficulties absorbing information. He suffers debilitating fatigue and lacks motivation.

As a result of the cognitive problems, the claimant is also no longer able to manage his finances and, in consultation with him and his family, we arranged for a Deputy to be appointed to assist him in managing his money going forward.

Also, following recommendations by the medical experts instructed for the legal claim, we also arranged for a case manager to be appointed and a rehabilitation regime to be set up to provide him with the care and medical treatment he so vitally needed.

Insurers acting on behalf of the driver offered compensation of just £200,000, an offer Hudgell Solicitors says was never realistic or appropriate given the life-changing impact of the accident.

We advised the claimant that this would be a significant under-settlement. Both he and his family need support going forward to deal with his condition and to ensure they are advised on how best to cope physically, mentally and financially.

With the offer so low, we issued court proceedings on the claimant’s behalf, and two weeks before trial, the defendants finally agreed to offer £1.4 m, which we felt was an acceptable settlement.
