Compensation for patient told life expectancy had shortened after surgeon’s heart operation error

A coronary artery bypass graft performed at the Guys and St Thomas Hospital in London failed as the surgeon mistakenly attached an internal artery to a cardiac vein instead of an artery as required.

It meant patient Peter Phillips’ blood flow was not improved, and also meant he was subjected to further procedures which would not have been required for 10-15 years had the bypass procedure been successful. He was also subsequently told his life expectancy would be affected.

The legal process

Despite the Trust denying breach of duty with regard to the operation not being performed successfully, it did admit that as a result of the error made, Mr Phillips required further treatment which he would not have required for 10 to 15 years. Following negotiations with representatives of the defendant Trust, a damages settlement was agreed without the need for a court hearing,
