£35,000 compensation for pedestrian, 60, who suffered fractured knee and ankle when hit by car

Becci Ashfield, a personal injury specialist at Hudgell Solicitors has supported her client, a 60-year-old woman, in her legal claim following an accident where she was hit by a car when crossing a road of queuing traffic.

The pedestrian accident resulted in our client spending a week in hospital to recover from her injuries. She was placed in cast from her left thigh to her ankle leaving her unable to walk, as a result she was confined to her bedroom at home for a number of weeks as she recovered from her injuries.

Although our client lived at home with her husband, he was unable to care for her due to his own disabilities. Her 83-year-old mother took the role of full time carer for the duration of her recovery.

With the legal expertise offered by Becci Ashfield, she was able to secure a £35,000 damages settlement, without the need to pursue the case in court. This came as a huge relief to our client as the prospect of having to appear in court is daunting and an event we try to avoid in as many cases as possible.

“I’m not sure what happened but the traffic was static, cars were queuing and backed up for some distance so it appeared fine to cross. I’d walked into the road in front of the cars which were coming from my right and when I reached the other side of the road I was suddenly hit from my left side,” she said.

“The car could only have been moving a couple of miles an hour at most. At first, I went onto the bonnet, I ended up on the floor almost under the wheels, it felt like I’d been hit twice.

“The driver said he’d not seen me as the sun was in his eyes. He must have just been moving up as the traffic slowly moved forward. At first I didn’t think the injuries were bad and I expected to be able to get up and walk, but when I tried I was in pain and I could see my knee was badly swollen.

“It was really difficult to live with; I couldn’t do anything and it was a good 10 months before I was walking again without crutches. I have been delighted with the support from Hudgells. Everything was explained to me, when I had questions – they were answered, and I am pleased with the compensation they were able to secure for me.”

Pedestrian accident claim – The legal case

Having taken a full and detailed statement from the client about the accident, Hudgell Solicitors made representations on her behalf to the insurers of the driver of the car.

We also secured medical records to evidence the injuries suffered and the treatment she required, which included surgery to insert metal into both her knee and ankle.

Liability for the accident was not disputed and the case was settled without the need to issue court proceedings.

As part of the claim, Ms Ashfield claimed compensation to cover the expected cost of possible future surgery required to remove metalwork and a potential knee replacement.

The case settled for £35,000.
