Street lighting engineer Malcolm Smart turned to our personal injury compensation claims team at Hudgell Solicitors for support when he suffered multiple fractures of his left leg and ankle in an accident at work. He fell three metres to the floor when a concrete lamppost he was working on snapped.
The legal process
This proved a difficult case as liability was disputed throughout by the two parties which were involved, his employer and the local authority which owned the lamppost. The case highlighted the need for experienced and qualified legal support, as both defendants denied any responsibility until the matter was set to go to court.
With both defendants denying liability solicitor Samuel McFadyen was at the stage of issuing court proceedings on the matter. It was at this stage that the defendants offered a joint five-figure settlement to compensate Mr Smart for the injuries suffered, and the impact it had on his life, including many months unable to work.
Hudgell Solicitors comment
“It was simply not right that our client found himself not only badly injured, but also stuck in the middle of two bodies simply looking to protect their own interests. Thankfully, by pursuing this case on his behalf to the courts, we did secure a joint settlement which reflected the impact this accident had on his life.” – Solicitor Samuel McFadyen.
“Hudgell Solicitors have been fantastic. They’ve helped me so much, physically, but also mentally. Knowing they’ve finally agreed to compensate me and take responsibility for what happened to me makes me feel so much better.” – Malcolm Smart.
