A 17-year-old man suffered a life-changing injury at work when his leg was crushed under a steel beam. Such was the extent of the break, the fracture failed to heal and became infected, meaning he required further surgery more than two years after the accident, and had to have an external frame fixed to his leg for support. At the time of the claim settling, he still faced another 12 months with the frame in place before further surgery could be considered.
The Legal Process
An accident at work personal injury case was filed against insurers acting on behalf of the farm where the young man had been working at the time. Hudgell Solicitors were instructed after the client had started legal proceedings himself. The settlement was achieved without the need for a court hearing after negotiations with representatives of the defendants on damages, taking into account substantial medical opinion gathered as part of the legal support.
The £500,000 settlement covered the pain, suffering and loss caused by the injury, as well as providing access to a comprehensive rehabilitation package to aid the victim in his recovery. As part of a rehabilitation programme, he has benefitted from private counselling and had the support of a dedicated GP, consultant plastic surgeon, consultant orthopaedic surgeon, physiotherapist and dietician. The settlement also covered future care and loss of earnings, future medical expenses and therapies, the cost of adaptions required at his home and costs incurred by his family, including loss of earnings of his mother, who gave up work to care for him.
