A schoolboy suffered long term physical and psychological injuries when slicing through his hand with a bill hook on work experience at a farm. His injuries left him in constant pain whilst psychological injuries, including Post Traumatic Stress Disorder (PTSD) and depression, left him reluctant to leave his home. More than four years after the injury the victim still struggles with pains in his hand and has limited functionality, continues to have nightmares about the accident once or twice a week.
The Legal Process
This was a complicated case as there were three defendants with regards to liability for the accident. These were the boy’s school, a company responsible for operating the work experience programme and the local authority which organised the placement. All denied responsibility until a joint settlement was finally reached four years after the accident. Despite the long term denials, Hudgell Solicitors secured funds to cover the costs of rehabilitation support from two defendants prior to the joint admission.
A £350,000 damages settlement ensured a vital programme of rehabilitation support could be provided. The client benefitted from a dedicated case manager to oversee his progress, weekly psychological counselling, hand therapy treatment, had a personal assistant and weekly tutoring to help his education. A vocational work programme was also put in place to help him prepare for a return to work. Rehabilitation continues after the financial settlement.
