Errors led to baby being stillborn as midwives sent mum home despite drop in heartbeat
Hudgell Solicitors supported a mother whose baby was stillborn in a case against a Hospital Trust after midwives sent her home twice despite her high blood pressure and monitoring showing dips in her baby’s heartbeat. The claim led to the Trust admitting that had the errors not been made, our client would not have suffered the stillbirth of her child.
The legal process
Our medical negligence department issued a claim which alleged action should have been taken to deliver the baby by Caesarean section in light of the signs of distress, the reductions in the baby’s heartbeat and the increasing blood pressure of our client.
The claim resulted in admissions being made by the Trust and a damages settlement offered without need for a court hearing. An undisclosed damages settlement was agreed.
Hudgell Solicitors comment
“The mistakes made in this case were unforgivable and had very tragic consequences. We are pleased that our client got the outcome she wanted, which was admissions of errors. It is to be hoped that lessons have been learned as a result of the case.” – Sarah Daysley.
“This was the best outcome I could have hoped for as it helps to know they have admitted it was their fault. I am so glad I contacted the solicitors when a friend suggested it to me. I was lucky I had people to speak up for me, but not everyone does. It’s awful to think of hospitals making mistakes which are costing lives.” – Laura Tate
