Passengers urged to seek legal advice
Hudgell Solicitors’ accidents abroad lawyers have many years of experience ensuring clients who are injured while onboard planes receive the compensation they are entitled to.
Passengers who are injured while flying are often covered by the Montreal Convention and can claim damages for accidents involving falling luggage, hot drink spills and those sustained as a result of severe turbulence.
If you were injured during a flight, we urge you to get in touch with our airplane accident specialists.
John Moody, our travel litigation executive, says travellers injured as a result of plane accidents need advice from specialist lawyers:
We have advised clients they could bring a holiday injury claim under the Montreal Convention which governs international aviation.
The Montreal Convention imposes a strict liability on airlines for personal injury which occurs during a flight.
In order for the passenger to make a compensation claim, the accident must be an unexpected or unusual event or happening that is external to the passenger.
A severe case of turbulence without warning would satisfy this definition of an accident as it was unexpected and an unusual event which passengers had no control over.
Not all legal firms specialise in plane accidents but Hudgells has a team which has specialised in such cases for decades.
Experts in travel accidents
Hudgell Solicitors has successfully sought compensation for many other clients under the Montreal Convention, including a woman who received £143,000 after sustaining serious long-term injuries when luggage fell onto her head from an overhead locker, adults and children scalded by hot drink spillages and a traveller whose knee was injured when it was hit by a trolley.
Mr Moody, added:
Anyone who was on that flight from London to Singapore and was injured should consider taking legal advice as compensation could cover the cost of health care, flights and loss of earnings.
