How long does a medical negligence claim take?

Every medical negligence case is different which means there is no set length of time for how long will take to settle your legal expert will give you an indication of timescales at the outset and will of course keep you updated during the claim as things progress.

These types of cases however are some of the more complex personal injury cases, and as such they can take a long time to resolve.

Although it’s not possible to accurately predict how long a case can take before starting work on it, here is a rough guide:

  • For simple claims, which are admitted in the early stage and that don’t end up going to trial: 18 months to 2 years
  • If a trial is required and your case goes to court: 5 to 7 years
  • Cases where there is a significant or ongoing or developing injury or in a claim that is denied by the medical professional’s representative: 6 to 8 years

If you believe you have been the victim of medical negligence, don’t get put off by the length of time it can take for a case to be settled. In some cases, if the medical professional that has caused the harm accepts liability, an interim payment can be arranged while the full extent of damages you are owed is resolved, to ensure that you have the funds needed in the meantime.
